The United States of America (U.S.) tax laws require banks to have a completed and signed original Form W-8BEN, for each customer who is a foreign person or legal entity (businesses, non for profit organizations, etc.). The Form W-8BEN is valid only for a period of three years. Each name holder listed in the account is required to file a separate Form. If we do not have an original Form W-8BEN in our files, we are required by law to withhold taxes at a rate of 30% of any interest paid.
In addition, the law requires that if you have a mailing address in the U.S., or if you have arranged for “hold mail services” offered by our bank, you need to complete and sign the document titled “Attachment to Form W-8BEN,” which must include an explanation of why you have a U.S. mailing address if you are a foreign person residing abroad.
For your convenience, we have prepared a set of documents covering every item of the Form W-8BEN including filled samples. We have also posted the original instructions issued by the Internal Revenue Service (IRS). Below, you will find the documents you need to comply with the above mentioned requirements.
