Your Financial Privacy Rights

At BAC Florida Bank we recognize the high value you place on your privacy. We are committed to respecting that privacy and to protecting the privacy of nonpublic information, which you provide to us or which we may gather from other sources. Nonpublic personal information means information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records.

We extend this privacy protection to all of our customers who have a continuing relationship with us, such as:

  • Deposit account

  • Loan account

  • Credit card

  • Safe deposit box

  • Self-directed individual retirement account where we act as custodian or
    trustee

  • Financial, investment, or economic advisory services

  • Home mortgage brokerage

  • Internet banking

The Information that We Collect

We collect nonpublic personal information about you from the following sources:

  • Information we receive from you on applications or other forms

  • Information about your transactions with us

  • Information about your transactions with our affiliates

  • Information about your transactions with nonaffiliated third parties

  • Information from a customer reporting agency

  • Information from a customer survey

The Confidentiality, Security, and Integrity of Your Nonpublic Personal Information

We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your nonpublic personal information.

We will not disclose nonpublic personal information about you to anyone except as disclosed in this policy or as permitted by law.

Nonpublic Personal Information and Affiliates

We disclose nonpublic personal information about you to affiliates. An affiliate is a company we own or control, a company that owns or controls us, or a company that is owned or controlled by the ownership that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control. Here are the kinds of nonpublic personal information we disclose to our affiliates:

  • Information about your transactions and experiences with us, such as:

    • Types of Accounts

    • Payment History

Federal law allows us to disclose the information listed above with our affiliates and we do so where it is required to provide you with service or to offer you additional products. Because of this, you do not have a right to opt out of the disclosure of this information. Opt out means to prevent our sharing of this information.
We also share other information not taken from transactions and experiences. This is nonpublic personal information we receive from you on an application or other forms such as:

    • Name

    • Address

    • Assets

    • Demographics

You may opt out of the disclosure of the information listed above.

Nonpublic Personal Information and Nonaffiliated Third Parties

We will not disclose nonpublic personal information about you to nonaffiliated third parties except when they provide services to the bank or directly to our customers, or as permitted by law. We do not share nor sell your personal information for marketing purposes.

Where we engage the services of nonaffiliated third parties to provide services to the bank or to you, we require confidentiality agreements.

Nonpublic Personal Information and Former Customers

We do not disclose nonpublic personal information about former customers, except as permitted by law. Former customers can also elect not to have their information shared, even after their relationship with us ends.

Types of Affiliates

We disclose nonpublic personal information about you to the following types of affiliates:

Financial services providers, such as:

  • Mortgage bankers

  • Securities broker-dealers

  • Insurance agents

  • Other banks

Where we engage the services of a financial services provider to provide services to the bank or to you we require confidentiality agreements.

Your Right to Block the Disclosure of your Nonpublic Personal Information

We disclose nonpublic personal information about our transactions and experiences with you to our affiliates. We also disclose other nonpublic personal information about you to our affiliates (that is, nonpublic personal information beyond our transactions and experiences with you), unless you tell us not to disclose this other nonpublic personal information. Your decision to block the disclosure of your nonpublic personal information will apply to all products and services you receive from us.

If you have a joint account, an opt out by one of the joint tenants applies to all joint tenants.

This policy statement takes the place of any previous privacy policies issued by BAC Florida Bank.
